Patent TWiL on Friday (#twit #twil #twil28)

This Friday, August 7, this WEEK in LAW will be live on TWiT.tv at 11 a.m. Pacific. You can watch at live.twit.tv, or on Stickam or UStream. Chat with us real-time at irc.twit.tv or on FriendFeed (the Stickam and UStream channels have their own chat as well, but I won't be monitoring those while we're on.) If you can't make it live, you can, of course, always subscribe in iTunes or your favorite podcatcher (more options here).

Guests are patent lawyers Adam Bagwell, Matt Buchanan, and Steve Nipper. Discussion notes are being aggregated here. So far we plan to discuss Volumedia's "podcasting patent," patent lawsuit abuse, patent reform, Web 2.0 and uspto.gov, Peer-to-Patent, and more. Leave a comment here, tag something for:thisweekinlaw in del.icio.us, or @ me on Twitter to let us know what else is on your mind.

What rights are there for ISP users if IPSs can write agreements like:
(for Wave Cable, can be found at (http://www.wavebroadband.com/img/subagree.pdf)

(b) Republication:

(i) I acknoledge that material posted or transmitted through the HSD

Service may be copied, republished or distributed by third parties, and

that Wave Broadband Parties will not be responsible for any harm

resulting from such actions.

Does this mean that ISPs can listen in as we transmit digital photos to be printed and then steal these photos for advertisers? It sounds like the ISP would have free reign to "mine" a users data stream with this type of agreement.

Hello,

I love This Week in Law. I'll be starting law school next week with plans to focus on IP and technology-related law. I hate being a vote grubber, but I was selected as one of 10 finalists in a YouTube video contest with a chance at winning a $10,000 scholarship. My video is a funny cartoon about the intersection of law and advancing technology. I just thought it was at least relevant and you might enjoy it.
